1. Scope. This Acceptable Use Policy (AUP) governs the usage of ProMission Projects' products and services (Services). This Policy is incorporated by reference into each contract ProMission Projects enters into with a customer (Customer) for the use of such Services. ProMission Projects may modify this Policy at any time without notice Use of ProMission Projects Services constitutes acceptance and agreement to ProMission Projects’ AUP as well as ProMission Projects’ (Terms of Service) TOS. Customers are responsible for any misuse of Services and must keep passwords secure.
2. Purpose. The purpose of this Policy is to enhance the quality of the Services and to protect ProMission Projects' customers, and the Internet community as a whole, from illegal, irresponsible, or disruptive Internet activities.
3. Prohibited Uses. Users may not: a. | Utilize the Services illegally. Customers may not use Services for any illegal purpose or in support of illegal activities or evil plans. | b. | Utilize the Services to harm a minor. Customers will not use Services to harm or attempt to harm a minor in any way. | c. | Utilize the Services to send mass unsolicited e-mail (SPAM) to third parties. The Customers transmission of any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited using Services. | d. | Utilize the Services in Fraud. Customers using false or forged documents, writings, activity or false claims of any kind with intent to deceive with Services will not be tolerated. | e. | Utilize the Services to Infringe on Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right. | f. | Utilize the Services to access another computer system illegally. Cyber crime will not be tolerated. |
4. Violations.
a. | Disclaimer: ProMission Projects expressly disclaims any obligation to monitor its Customers and other Users with respect to violations of this Policy. ProMission Projects has no liability or responsibility for the actions of any of its Customers or other Users or any content any User may post on any Web site. | b. | Remedies: If ProMission Projects learns of a violation of this Policy, ProMission Projects will respond to the applicable Customer and may take any of the following actions, in accordance with the severity and duration of the violation: | | i. | Warning the Customer verbally or written. | ii. | Suspending the offending Customer from the Services. | iii. | Terminating the offending Customer from the Services. | iv. | Removing the offending content. | | |

5. Reservation of Rights. ProMission Projects reserves the right to cooperate with appropriate legal authorities in investigations of claims of illegal activity involving ProMission Projects’ Services, Customers and other Users. ProMission Projects reserves the right to apply any of the remedies listed in section 4.b.
